Terms of Service.

These Terms of Service ("Terms") govern your use of RootRecord's websites (including rootrecord.info), accounts and billing, and RootRecord desktop software for Windows (together, the "Services"). By using the Services, you agree to these Terms and to our Privacy Policy. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

Who we are

"RootRecord," "we," and "our" refer to Root Record Software Solutions, which operates the Services. Contact details appear on our Contact page. Seller name, address, and Hawaii GET license are under Business and tax information below.

What the Services include

Website and account. rootrecord.info provides marketing pages, account sign-in and sign-up, plan information, and (where available) billing through our payment provider. We may add, change, or retire web features over time.

Desktop programs. We offer Windows desktop applications such as RootRecord Business Manager and RootRecord Weather Manager, and may release additional programs over time. Each program includes a free local tier so you can use core features on your device without a paid subscription. Unless a feature explicitly sends data to our systems, your primary operational data stays on your device. Where a product allows it, you may start in a limited local-only mode without creating an account; creating an account and signing in unlocks paid tiers, persistence of sign-in, sync, online backup, and other online features as described in each product and in our Privacy Policy.

Feature lists, system requirements, and product-specific behavior are described on our Products pages and in-app. The Services are provided as they are available and may evolve.

Eligibility and accounts

You must meet the minimum age shown at account sign-up (or the age required in your region to consent to these Terms, if higher). You agree to provide accurate account information and to keep your login credentials secure. You are responsible for activity under your account unless you notify us of unauthorized use. You may not share account access in a way that circumvents plan limits or licensing.

Acceptable use

You will use the Services only in compliance with applicable law. You will not probe, scan, or attack our systems; attempt unauthorized access to other users' data; overload or disrupt the Services; reverse engineer our software except where applicable law expressly allows; or use the Services to distribute malware, spam, or unlawful content. We may suspend or terminate access for violations or for operational or legal reasons.

Plans, billing, and subscriptions

Online account features may be offered on Free, Monthly, and Lifetime plans as described on our Pricing page. Current prices and benefits are also shown when you sign in on Account. Paid plans are charged through our payment provider; we do not store your full card details.

• Free (account): No payment for the Free online account tier. Includes the online features and limits in effect for that plan when you use it, in addition to the free local desktop capabilities each app already provides on your device.
• Monthly: Recurring subscription at the price shown at checkout (for example $4.99 USD per month when that price is in effect), billed until you cancel through your account or payment provider self-service where available.
• Lifetime: A one-time purchase at the price shown at checkout (for example $150 USD when that price is in effect). Where we advertise it, Lifetime includes access to eligible online features for the life of the Service, plus all current and future RootRecord desktop programs and updates we offer under the RootRecord brand as described on Pricing. It does not guarantee features we never build, or services sold under a different brand or by a different seller.
• Renewal and cancellation: Monthly plans renew until you cancel through your account or payment provider self-service where available. Cancellation generally takes effect at the end of the current billing period unless stated otherwise at checkout.
• Plan changes and taxes: We may change recurring prices or plan limits with reasonable notice where required. Taxes may be added where applicable.
• Downgrades and lapses: If you cancel Monthly or your subscription lapses, your account typically returns to Free limits. Data retention is described in our Privacy Policy. Billing references for lapsed accounts may be retained for a limited period as described there.
• Refunds: Where our payment provider or applicable law offers a refund or chargeback process, those rules apply. Otherwise, fees are generally non-refundable except where we choose to offer a refund or where law requires.

Desktop software may show read-only, limited, or locked states when your plan or sign-in status does not include a needed feature, or when you use a product-specific local-only mode without an account. Check the in-app messaging and your Account page when you are signed in.

Software license

We grant you a personal or internal business non-exclusive, non-transferable license to install and run the number of copies of our desktop software permitted by your plan and fair use. You may not rent, lease, sell, or sublicense the software; remove notices; or merge it into a competing product. Updates may be supplied automatically or as separate downloads. Open-source components, if any, are governed by their respective licenses.

Your content, backups, and compliance

You retain rights to data you enter. You are responsible for the legality and accuracy of your data, for securing your devices, and for keeping backups of local databases and exports you care about. We are not responsible for loss of local data if a device fails or the app is removed without backup. For online data, export and deletion options are described in our Privacy Policy and on Account where available.

Data, privacy, and AI

Our Privacy Policy explains what we collect, how we use it, and your choices. It is part of your agreement with us.

Where you use online features (including dashboards, reports, or tools that call our servers), you grant us the rights reasonably needed to host, process, secure, and improve those features, as described in the Privacy Policy.

Where AI-assisted reporting or similar features are offered on online services, inputs and outputs may be stored and used to train and improve our own models as described in the Privacy Policy. We do not sell your personal information or use that data to train unrelated third-party commercial models for their own products.

No professional advice

The Services are tools for your own planning and operations. They are not legal, financial, tax, medical, or safety advice. You are responsible for decisions you make and for meeting regulations that apply to your business or jurisdiction.

Third-party services and links

The Services may link to or rely on third parties (payment processing, hosting, weather data, sign-in providers, etc.). Their terms and privacy policies apply to what they provide. We are not responsible for third-party sites or services you choose to use.

Affiliate links

Some links (for example to retailers such as Amazon) may be affiliate links. Clicks may pass through our redirect pages. If you make a qualifying purchase, we may earn a commission at no extra cost to you. See our Privacy Policy for what we log. Amazon and the Amazon logo are trademarks of Amazon.com, Inc. or its affiliates.

Availability and changes

We aim for reliable service but do not guarantee uninterrupted access. Online infrastructure may be unavailable for maintenance; where we use scheduled quiet hours (for example overnight in Hawaii–Aleutian time), that window may apply as described in our Privacy Policy. We may modify, suspend, or discontinue parts of the Services with or without notice, except where law requires otherwise. If we materially change these Terms, we will update the "Last updated" date; continued use after changes constitutes acceptance unless law requires a different process.

Warranty disclaimer

To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be error-free or meet every use case.

Limitation of liability

To the fullest extent permitted by law, RootRecord and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities. Our total liability for any claim arising out of or relating to the Services is limited to the greater of fifty U.S. dollars ($50) or the amounts you paid us for the Services in the twelve (12) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.

Indemnity

You will defend and indemnify RootRecord against claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Services, your content, or your violation of these Terms, except to the extent caused by our willful misconduct.

Suspension and termination

We may suspend or terminate access to the Services or close accounts that violate these Terms, pose a security risk, or remain inactive for an extended period where we give notice when practical. You may stop using the Services at any time and may delete your account where the product allows. Provisions that by their nature should survive (including warranty disclaimers, liability limits, and indemnity) survive termination.

General

These Terms together with the Privacy Policy are the entire agreement between you and RootRecord regarding the Services. If a provision is unenforceable, the remainder stays in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce a provision is not a waiver.

Business and tax information

Paid plans may be subject to Hawaii General Excise Tax (GET) where applicable. When tax applies, your payment receipt from our payment provider usually shows the seller name, tax charged, and any tax identifiers required on the receipt.
